Children at Risk – Privacy Policy

The privacy policy (this “Privacy Policy”) made available by Children at Risk, a 501(c)(3) non-profit organization (“Children at Risk,” “we,” or “us”),  explains the online information practices of Children at Risk regarding the collection of data from you as part of the normal operation of its websites (each a “Website” and, together, the “Websites”).  This Privacy Policy also explains how we use or disclose this information.

IMPORTANT NOTE: By accessing, using, or viewing any Website, you expressly consent to our collection, use, and disclosure of your personal information under the terms and conditions of this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of each Website.  People who visit a Website are referred to as “Visitors.”

In this Privacy Policy we refer to companies affiliated with Children at Risk. These means all or any subsidiary companies of Children at Risk and any associated companies in the same common ownership as Children at Risk.

When reading through this Privacy Policy please read the entire contents and do not rely on headings, which are illustrative only.

1. Collection and Use of Information

Even if you only browse through a Website and read the information contained on the web pages, Children at Risk will gather certain information about your visit automatically. This information does not identify you personally, but may, for example, reflect how you found or were directed to or used the Website. Each Website automatically gathers your IP address when you use any portion of the Website. It also may collect the name and URL of the Website that you visited immediately before your visit to the Website. Children at Risk may use this type of non-personal information on a cumulative basis to better understand what pages Visitors and prospective participants access or visit, and Children at Risk may disclose this information to business and trade partners as well as companies affiliated with Children at Risk.

This privacy policy also relates to our collection and use of any personal information through your use of any of our Websites and any personal information that you provide to us through email. We explain in this policy what information we collect about you through your use of any Website and how we use that information. When you participate in, access or sign up to any of our services, activities or online content, such as class information, email publications, blogs, e-newsletters, competitions, event invitations, calls-to-action for campaigns, or message boards, we may receive personal information about you. This may consist of contact information (e.g., name, email address, physical address, and telephone number) but may also include other personally identifiable information. We will use your personal information for a number of purposes which include, responding to your requests for information or e-newsletters, adding your details to our list of persons who receive e-newsletters and providing these to you on a regular basis. We will also compile data based on responses received from Visitors to the Websites in order to allow us to analyze the experience of Visitors so that we can improve the services that we currently offer and predict future services that we may consider offering. The data which we compile from responses received from Visitors may also be shared with third party service providers, but the information shared includes no personally identifiable information. In other words, your name and personal information is not provided to such third party service providers. The purpose of sharing such information with third parties is to allow them and us to analyze the profile of our Visitors and help us and them to provide a better Visitor experience. By using any Website and providing this information you are deemed to agree to these uses of data. If you do decide to provide information through the Websites or to otherwise contact Children at Risk then it is implied that you consent to receiving a response from Children at Risk to your email address or via other contact information that you provided to Children at Risk. Note that requesting information through a Website, including using the “Contact” or “Contact Us” page, will not confer any right for you to receive a response. Any requests for information may be responded to entirely in the discretion of Children at Risk and there is no obligation on the part of Children at Risk to respond or to provide any information. 

If you provide Children at Risk with your email address or other personal information, except for Children at Risk’s marketing purposes or as set forth in this Section 1, we do not use such email address or other personal information to send you commercial or marketing messages without your consent. However, by providing us with your email address or by sending us an email inquiry, your consent will be implied for Children at Risk to use your contact information not only to respond to your request(s) for information but also contact you about available products or services and provide you with advertising and other promotional material connected with Children at Risk that we think may interest you, including (but not limited to) e-newsletters and class information.  In addition to these marketing purposes, we may use your name and email address without further consent for non-marketing or administrative purposes (such as notifying you of major updates, service needs, or items for which you have requested communication).

In addition, we may collect information such as name, phone number, email address, and desired position from Visitors to the “Jobs and Internships” page of the Websites (“Applicants”). We also collect information contained on resumes voluntarily uploaded or sent by Applicants, as well as any information or documentation sent to Children at Risk via any of the email addresses listed on job postings within the “Jobs and Internships” page.

From time to time, Children at Risk may host or sponsor certain events, some of which may be listed on our “Events” page (“Events”).  In connection with such Events, Children at Risk may collect information such as name, email address, age, and phone number from Visitors seeking to attend such Events or from Visitors who volunteer such information to any of the email addresses listed on the “Events” page and sub-pages.  If an Event includes tickets that may be purchased online, Children at Risk may include a link on the Website(s) to purchase such tickets.  All purchases related to Events are considered Payment Transactions and are subject to the provision below.

We may use certain third party payment processors (“Payment Processors”) to process personal financial information such as name, phone number, address, zip code, and credit card or bank account information for the purposes of allowing Visitors or Volunteers (as defined in the Terms) to purchase various items via the Websites or to make a donation to our organization’s fundraising efforts (collectively, the “Payment Transactions”). This information is provided directly to such Payment Processors by Visitors and Volunteers, and Children at Risk does not store this information on its servers or computer systems (with the exception of individual Visitors and Volunteers who consent to disclosure of the amount of a donation and/or the name(s) of the donor party). Such information is used solely for the purpose of allowing Visitors and Volunteers to make Payment Transactions.

We may collect certain personal information from Visitors who are interested in registering for any of the classes listed on our “Find a Class” page (the “Registrants”).  We may share such information with the third party organizations managing or providing such classes (the “Class Providers”) for the purpose of registering or providing information to Registrants for the classes and services they have requested.

2.Children’s Information Policy

We do not knowingly solicit any personal information from children under the age of 13. If we are made aware we have collected personal information from a child under 13 years old in a manner that is inconsistent with the Children’s Online Privacy Protection Act of the United States, then we will delete this information as soon as practicable.

3.Cookies Policy

When you visit a Website, Children at Risk may place one or more “cookies” on your computer. These are small text files that contain information that allows Children at Risk to identify your computer or browser. They allow websites to store information such as user preferences. We use cookies for the following purposes:

Identify you when you access, visit, or log-in to a Website. This enables you to re-visit a Website without having to re-enter information upon each visit.

To note the different areas of the Websites which have recently been accessed through your computer. Information collected in this way is used to develop and manage the online services of Children at Risk by, for example, storing information about your preferences so as to enable Children at Risk to customize the Websites according to your individual interests.

Delivering content on the Websites which is relevant to your individual interests.

Monitoring the effectiveness of our marketing or fundraising campaigns.

Tracking your entries, submissions, and status in promotions, sweepstakes, and contests.

Improving the content of the Websites and conducting various other diagnostics to improve our services. We may, for example, use cookies to monitor aggregate metrics such as total number of Visitors and pages viewed.

Analyzing and improving security of the Websites.

If you wish, you can set up your computer in a way to refuse to accept cookies. However, if you do so you may be unable to access parts of the Websites.

4.Disclosure of Information

The information we collect is used to improve the content of the Websites, the quality of our service, fill open positions within our organization, and facilitate fundraising efforts, promotions, sweepstakes and contests. The personal information we collect is not sold to other organizations.  Nor is such information shared with other organizations for commercial purposes, except: (1) to provide products or services you have requested; (2) when we have your permission to share your information; (3) to process a Payment Transaction; (4) to register a Registrant for a class; or (5) when it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms, or as otherwise required by law. 

Although our suppliers of web-related services may see your personal information, neither we nor they will send such information to anyone else outside of Children at Risk or its affiliates without your permission.   Notwithstanding the foregoing, Children at Risk will request that its suppliers of web related services and any other services provided via the Websites observe the restrictions set forth in this Section 4.  However, Children at Risk makes no representations or warranties about the acts or omissions of such suppliers.

5.Sharing Information

Children at Risk and its licensors own the code, databases, and all rights to the Websites and any feedback you provide.  As between you and Children at Risk, you retain all rights to personal information you provide to Children at Risk through the Websites; provided that if you incorporate into feedback any User Content, you hereby grant Children at Risk a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, and display the User Content when operating the Websites and for Children at Risk’s internal business purposes.

Your contact information may be available to or provided to third-party service providers and contractors (including Payment Processors), Class Providers, as well as board members of Children at Risk. There are certain other exceptions when Children at Risk may provide your contact information to third parties:

• Children at Risk may disclose personal information:
  • in response to legal process, for example a court order;
  • in response to a law enforcement agency’s request;
  • where otherwise required by applicable laws or government requirements;
  • if it is necessary to investigate, prevent or take action with regard to a violation of the Websites, the Terms, or to verify or enforce compliance with the policies governing the Websites;
  • if it is necessary to protect the rights and property of Children at Risk; and
  • in the event of a Transfer, as set forth in the section below.
• Children at Risk may use personal information when investigating and correcting technical problems and malfunctions in the Websites or the computer systems that support the Websites. 

In order to maintain accurate records concerning communications that Children at Risk may have received from or sent to you, Children at Risk may also indefinitely store any information that you provide to Children at Risk through the Websites.

6.Transfer of Information

Donor lists, Visitor lists and other information are properly considered assets of a business. Accordingly, if we merge with another entity or if we sell our assets to another entity (collectively referred to as a “Transfer”), our lists and information, including personal information you have provided us, would be included among the assets that would be transferred and we would request that the entity treat your information in accordance with these terms.  Children at Risk makes no guarantees as to whether such entity will treat your information in accordance with these terms and disclaims any liability arising out of such entity’s failure to do so.

7.Protection of Information

Although Children at Risk takes reasonable measures to ensure the security of the data you may choose to provide Children at Risk from loss or misuse (including requesting that Payment Processors acquire SSL certificates), unfortunately the transmission of data through the Internet cannot be guaranteed to be 100% secure. Neither Children at Risk, nor its affiliates, nor any of their respective employees, officers or agents or the provider of the internet services on behalf of Children at Risk or the creator of the Websites can give any representation or warranty as to the absolute security of the data transmitted using the Websites and cannot give any guarantee that such data will not be compromised by bad actors. If you choose to provide data to or allow collection of data by Children at Risk or any of its affiliates or any of their respective officers, directors, employees or agents, then you do so understanding your own risk.

8.Third-party Websites

The Websites contain links to other websites that are not maintained or controlled by Children at Risk. Children at Risk is not responsible for the privacy practices of such other websites, and you are encouraged to review their privacy policies (if any). The fact that a link to a third-party website exists on the Websites does not mean that the third-party site operates under the same or similar privacy practices as set forth in the Children at Risk Privacy Policy. The policies and procedures we describe here do not apply to third-party websites.

9.Notification of Changes

We reserve the right to revise this Privacy Policy at any time. If we make substantial changes to this Privacy Policy, we will endeavor to notify you of such changes (e.g., by email or an alert on the Websites for a period of time).  However, regularly reviewing this page is the best method to ensure you are always aware of the information Children at Risk collects, how it is used and under what circumstances.

10.Changes to Your Information

You may change or update information you previously provided to Children at Risk by contacting the Children at Risk via e-mail at [__] or regular mail at 2900 Weslayan St., Suite 400, Houston, Texas 77027.  Such change may be subject to a fee paid by you to cover our costs.

11.Stopping E-mails and Promotional Materials
